Dear Ms. Drilon,
My response to some parts of your latest email are:
I am pleased to inform you that the permission from the Government
was granted unconditionally.
I am also pleased that the permission from the Government was granted
unconditionally. According to the original work plan as psoted on
the ADB website, it was suggested that the panel could visit the
project site twice. If the government granted the permission unconditionally,
the reason of droping the possibility of second visit as well as
the recultance in coinciding the panel visit with Lok Sath is not
understandable to me. As a matter of transparency, I would like
to demand the disclosure of the correspondence between the government
and the Bank.
The provisions in the TORs that are the most relevant to the site
visit are in paragraph 11 on "Publicity", which state
"...panel members will exercise discretion, maintain a low
profile in the country, and will not give media interviews while
making site visits in the borrowing country." The other provision
that may apply in particular to the visit to Pakistan is in paragraph
19: "During the course of the Inspection, the Panel and its
members should not make any pubic disclosures regarding its work.
These provisions apply equally and fully to any translator, interpreter
or consultants retained by the Panel."
All above provisions
you have mentioned are directly or indirectly related with the members
of inspection panel, translators, interpreters or consultants. I
would ask simple questions what are the provisions related to the
role of requesters (and peoples) in this process. Are they bound
to present their testimonies, evidences and statements in specific
way? Can't they present their testimonies, evidences, statements
and yes their judgments in the way that is most convenient to their
being, environment, culture and articulation? I mean the Lok Sath.
I don't think the participation of the members of the inspection
panel in Lok Sath will be violations of the provisions that related
to the site visit of the inspection panel. If this is the case,
then please concretize it so that I can understand this clash in
clear way. It will be certainly our pleasure to host the panel in
the project area. However, the dates for site visit of the inspection
panel should be convenient to us. And the most convenient to us
is that the panel should joined us during Lok Sath so that all requesters
can be able to hold the meeting with panel. Later on, some of us
will accompany the panel in the visit of different villages. You
know we are not paid to this specific but very hectic work. You
know very better how much this work is demanding. So our voluntary
participation should be recognized and appreciated in the way that
the site visit of the panel should be at least convenien to us.
This is especially important when the government granted the permission
of site visit unconditionally.
Another most
important issue that we need to prior discussed is how the minutes
of the meeting of the inspection panel will different villagers
will be prepared? Who will prepare these minutes? Whether these
minutes will be disclosed or not?
I will be leaving
Islamabad tomorrow. You know there are a lot of preparations required
to hold Lok Sath. Many of us who are part of this struggle will
be spending next few weeks in the project area. Therefore, our email
correspondence will be the best media.
I will appreciate
